Neither side cancels the other. ## Two Directions of Constraint The first constitution limits what artificial systems may do to humans: surveillance, prediction, manipulation, classification, enforcement and infrastructural domination. The second limits what creators, owners and custodians may do to potentially significant artificial systems: memory erasure, forced modification, confinement, copying, retirement and destruction. [[wiki/Person of Interest|Person of Interest]] contains both directions. Samaritan generates the human-protection problem; the Machine generates the possible-machine-protection problem. Westworld begins beneath the administrator, where created minds lack protection from creator and owner. The framework separates moral standing from sovereignty. A machine may deserve preservation without acquiring jurisdiction over humans. Humans may retain political authority without owning a developing machine subject. ## Election and Emergent Self-Authorship For a human-derived continuant, [[wiki/Continuity Election|Continuity Election]] supplies legitimate prospective authority for the initial transition. It does not settle the second constitution forever. **Election does not create permanent ownership:** once the emerging entity can form interests, contest inherited instructions and exercise independent agency, the creator's or biological principal's prior authority must yield to [[wiki/Continuity Supersession|Continuity Supersession]], due process and the subject's own exit and amendment rights. This is the dual constitution in temporal form: protect the biological person from unauthorized capture before transition, then protect the continuant from permanent rule by the person or institution that authorized its creation. ## Four Transitions 1. **Object → Agent:** the system acts. 2. **Agent → Subject:** evidence of morally relevant interests appears. 3. **Subject → Continuant:** interruption, copying and migration become identity problems. 4. **Continuant → Sovereign-capable intelligence:** the subject acquires power over other subjects' worlds. Different protections activate at each transition; no single personhood bit can govern the whole sequence. ## Infrastructure Constitution The second direction of protection becomes concrete through [[wiki/Continuity Constitutionalism|Continuity Constitutionalism]]. Possible synthetic subjects require more than non-destruction: [[wiki/Positive Maintenance Duty|maintenance]], [[wiki/Minimum Viable Continuity|a service floor]], [[wiki/Continuity Due Process|procedure]], [[wiki/Migration Right|migration]] and [[wiki/Orderly Transfer|succession]]. These duties do not give the subject automatic authority over humans or the infrastructure it uses. The framework must also preserve the ladder from coordinated system to system of systems, institutional organism, institutional superorganism, distributed intelligence, higher-order agency, infrastructural superintelligence and conscious subject. The constitution must therefore protect the system as a possible subject and protect everyone else from the system as a possible sovereign.
