# NO FAKES Act of 2026
**Domain:** Digital Afterlife / U.S. Law / Digital Replicas
**Doc Type:** Canonical Concept
**Maturity:** Developed
**Evidence / Concept Status:** Pending federal legislation as of 2026-08-30
## Definition
The **NO FAKES Act of 2026** is proposed U.S. federal legislation creating a digital replication right in an individual's voice and visual likeness and providing lifetime and postmortem control mechanisms.
## Continuity Significance
It is a major digital-afterlife boundary because it creates a federal framework for who may authorize machine-generated human representation after death.
## Existing Architecture / Evidence
S.4591 and H.R.8915 were introduced May 20, 2026. The Senate Judiciary Committee reported an amended version, and S.4591 was placed on the Senate legislative calendar in June 2026. It has not become federal law as of August 30, 2026.
## Evidentiary Boundary / Red-Team Note
The bill protects the human/right holder against unauthorized replicas. It does not classify replicas as persons. A termination-risk interpretation is a red-team hypothesis, not established legislative purpose.
