Different substrates require different protections. A biological brain may need bodily care; a digital mind needs compute, power and state integrity; a neural organoid may require welfare assessment and laboratory oversight specific to living tissue. The doctrine avoids substrate caste while refusing false equivalence. Current organoid and synthetic-biological-intelligence research does not establish consciousness. It does show that a clean human-versus-silicon boundary is a poor foundation for future law. Moral patienthood must also remain separate from legal personality, competence and political authority.
