## Definition
The **Texas securities transaction tax ban** is the state constitutional prohibition adopted by Texas voters in November 2025 against a tax on certain securities transactions and against an occupations tax. House Joint Resolution 4 placed the amendment before the voters.
## Structural Function
A statute can be amended or repealed through ordinary legislation. Constitutional placement raises the cost of reversing the policy and gives market operators a more durable expectation about the state tax environment.
The prohibition is the tax layer of the [[wiki/Texas Corporate Sovereignty Stack|Texas Corporate Sovereignty Stack]]. It complements the state-law, filing, court, and exchange layers but does not eliminate federal taxation, federal securities regulation, exchange fees, or every tax that may affect a market participant.
## War With Empire Context
[[articles/war with empire/Imperial Financial Influence Operations — Cutting the Head off the Snake|Imperial Financial Influence Operations]] treats constitutional entrenchment as part of the effort to make Texas a durable legal and market jurisdiction rather than a temporary policy environment.
## Key Insight
**Durable jurisdictional competition depends not only on present policy but on how difficult the policy is to reverse.**
