The agreement may remain formally valid while compliance, monitoring, adjudication or implementation fails. ## Failure Modes - ambiguous duties that cannot be operationally tested; - reservations, exceptions or limited jurisdiction; - weak reporting and concealed noncompliance; - no forum with authority to issue a binding decision; - judgments without effective domestic implementation; - retaliation or sanctions that are politically unavailable; - withdrawal, succession disputes or institutional collapse; - emergency derogation becoming normalized; - asymmetric dependence that lets a hosting state externalize harm. ## Continuity Context A continuity treaty might promise recognition of status, protection from deletion, portability, evidence exchange or emergency hosting. Each promise requires a corresponding implementation chain: competent authorities, authenticated records, a forum, interim relief, technical transfer capacity and a funded receiving institution. Recognition without a working migration path may protect legal status while the subject's infrastructure fails. ## Design Principle Treaty architecture should be evaluated by failure path, not ratification count alone.
